IMPORTANT LEGISLATIVE ALERT!
THE ANTIQUE BUSINESS IS IN PERIL!
Last summer we defeated the attempt by the pawnbrokers to require all
second hand dealers (everyone involved in the Antiques Trade) and
auction houses (eBay sellers included!) to:
1. Get fingerprints of all persons they purchase anything from.
2. Report all purchases to law enforcement within 24 hours.
3. Hold property for 30 days.
4. Pay a variety of annual fees (over $350.00!) to be allowed to
conduct business.
THIS BILL IS BACK!
It is now called AB 1178 and must be stopped! The sheer weight of
paperwork alone would put many antiques dealers out of business or
force them to move to a different state to avoid this repressive law.
Please write, email and call the legislators listed below to protest
this threat to the antique trades.
This bill will affect everyone in the collecting world if we do not
defeat it.

Thanks for all of the interest in this topic. I have been getting a lot of emails from people who are unable to locate the information online about the bill.
I know the info is hard to find, maybe because it is so new. Here is where you need to go:
http://www.leginfo.ca.
This will take you to the California Legislature page. That is where you need to click the button for bill info and type in the bill number (1178).
You can also check the old bill which was SB 1893, but make sure that you choose LAST year (2003-2004), not the current year.

An act to amend Section 21625 of the Business and Professions Code, relating to personal property.
LEGISLATIVE COUNSEL'S DIGEST
AB 1178, as introduced, Yee. Dealers and pawnbrokers.
Existing law generally requires a pawnbroker, secondhand dealer, coin dealer, and business machine dealer, as defined, to report specified transactions to the local law enforcement agency where their business is located.
This bill would make nonsubstantive changes to these provisions.
Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 21625 of the Business and Professions Code is amended to read:
21625. It is the intent of the Legislature in enacting this article to curtail the dissemination of stolen property and to facilitate the recovery of stolen property by means of a uniform, statewide, state-administered program of regulation of persons whose principal business is the buying, selling, trading, auctioning, or taking in pawn of tangible personal property and to aid the State Board of Equalization to detect possible sales tax evasion.Further, it is the intent of the Legislature in enacting this article to require the uniform statewide reporting of tangible personal property acquired by persons whose principal business is the buying, selling, trading, auctioning, or taking in pawn of tangible personal property, unless the property or the transaction is specifically
exempt herein pursuant to this article
, for the purpose of correlating these reports with other reports of city, county, and city and county law enforcement agencies and further utilizing the services of the Department of Justice to aid in tracing and recovering stolen property.
Further, it is the intent of the Legislature that this article shall not be superseded or supplanted by the provisions of any ordinance or charter of any city, county, or city and county.
