Good morning.

I know I am new here, but I am not new to eBay or Paypal. I used both to put myself through law school.

I am working on a potential class action lawsuit against Paypal.

What I am looking for is very specific. If you sold an item on eBay and used paypal, the buyer complained that the item was not as described, and paypal ruled in their favor and all they needed to do was send it back to you, I want to hear from you.

Sure.

I am an attorney from Philadelphia, PA. I am currently working on a case where a seller sold a case of hockey cards that were factory sealed for $1904. The buyer used the SNAD option and defrauded the seller out of their money.

Paypal claims they made an investigation, but its clear that they just looked at tracking numbers and nothing else, which is materially insufficient for such a large amount of money.

I believe there are others who have been put in this situation and I am trying to round up enough to put a class action suit together against paypal.

As far as credentials, I'm not crazy enough to post my full name or bar ID on a web-site I just joined, and I'm sorry I am a new member, this recently came into my office and I am scowering the web looking for more cases of this.

And I'm sorry I didn't look completely at this message board, there are quite a few message boards of its kind and I haven't had a time to review them yet.

There is no web-site yet as this is in the exploratory phase and a complaint has not yet been drafted.

As far as email mailing lists, you can buy an email mailing list of over a million ebay buyers for $19.95 and you can just use a web scraper to get every posted email address on this site, so why would I waste my time with that?

Bottom line is Paypal is punishing sellers for dealing with the fraudulent buyers eBay has invited with their policies, and I want to get at least some satisfaction for those who have been defrauded.

Still working on this case. I am going to get a web-site launched once we've collected enough cases to bring forward a class action. If you have been burned for SNAD, what do you have to lose?

Worse case scenario is I SPAM you, which I won't, and even if did, all you would need to do is to block the email it came from.

Let me point out a few things:

There are numerous sites out there for detecting and listing Preypal foibles via Google Search.

Second this is a recent registration of an account.

Third your state was not openly selected with a flag designation for revelation or validation to the casual observer.

Fourth there is no open letter of introduction-esquire?

Fifth the lawsuit pertains to sports cards and your handle involves a "Business Name" that is a long time sportscard dealer's name although muted.

Sixth your email contact is a gmail account.

Seventh, are you licensed to practice in CA, DE, & NE?

Just a few thoughts..................as I am a casual observer.

1. Not super internet saavy

2. Yes, this a new case. I will find cases of this with or without help from this message board.

3. Pennsylvania is the state, a breach of contract case can be brought in any jurisdiction, and the California court has ruled that the forum selection clause is in the user agreement is unconscionable and therefore unenforceable. I would like to bring this in the Southern District of Mississippi, which would mean I would need co-counsel. Since I'm a native of Starkville, MS, that should not be hard to find.

4. That would defeat the stealth-purpose.

5. My client sold a sealed case of cards, which is how this was brought to my attention.

6. Yes, I didn't want to post a law firm email because eBay does seek to squash lawsuits and law firms who dare challenge them. Gmail is as anonymous as it gets.

7. No, Pennsylvania, PAED, and the U.S. Tax Court. I would find co-counsel in the Southern District.


Look, to put it bluntly I was part of the team that got the VisaMoneyMaster settlement. Look it up. I broke off on my own shortly after that case. I know how to put a class action suit together, and this is being done under the radar.

Chances are, when we go to certify, eBay is going to try for the highest percentage (90%?) to certify the class, which is going to take quite a bit of time.

Hi frozenntimesports,

I am interesting in any action against the monopoly PreyPal and Bay.
I had my money freezed from PreyPal for 180 days without more explanations. I just released my money, but I am furious with them.
I have presented all invoices, sanitized invoice, paper trail, official letter from the manufacturer about the autheticity,... everything to them.
I lose some claims that PreyPal and I did not receive the merchandise back, but the customers told me that they sent to PreyPal. Where is my merchandise now ? What does PreyPal make with the merchandises that they collected ?
By the way, Bay closed my account two hours late, after I exchange PreyPal for my merchant account.
I never got any explanation why they did it.
The point is: your class action lawsuit will take care of diverse kind of cases or particularly of the kind of case you describe above ?

What I am looking for are specific transactions where a person sold an item on eBay, shipped it, accepted paypal, and then for whatever reason they used the SNAD (significantly not as described) clause to get a refund.

If that has happened to you, I want to get as much information as I can about it.

I am only dealing with SNAD at this time, I know everyone is upset by mandatory Paypal, I am too, but cases take a long time to develop, and this is the one on my plate.

I hazard to say, there are few sellers that have not run into unscrupulous ebay buyers along the way. The new rulings have put us at the mercy of eBay/PayPal and the predators. Is there any wonder you find us leary and suspicious?

I wish you success in your undertaking. Once you have a website, and sellers have a chance to get to know and trust you, I'm sure you will get more responses.

I find great disbelief in your credentials. Our attorneys (all of them) openly put their bar# and full name on their websites, or anywhere they are asked. Many states REQUIRE for attorneys to state their bar# when asked.

Again, any attorney working on a case (in MY case) happily obliged anyone wanting to know his name, address, phone number, and anything else to anyone because in his words "eBay gets alerted by word of mouth on all suits being taken against them from the court system.

I hate to say this, and it is my PERSONAL opinion, but I doubt you are an attorney, and if you are, it appears you are right out of school.

Sorry if this seems to the point so to speak, but do you know how many emails harvest tricks are REGULARLY put onto this list? seeking SUCKERS to respond? or harvesting other regions such as identity theft?

Sorry, I am not biting. More then enough people on this list would be willing to send you information, however I for one would NEVER give information to 1) a gmail account to begin with, 2) someone stating they were an attorney and not giving name, address, phone# or bar# and 3) someone stating they were an attorney and APPEARING to be so...vague on the initial greetings.

Try again..maybe in a year or so after eBay(R) is gone.
